InstaPods ("we", "us", "our") is operated by Vikas, a sole proprietor based in India. These Terms of Service ("Terms") govern your access to and use of our container hosting platform, website, APIs, CLI tools, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
InstaPods is a container hosting platform that allows you to create and manage cloud containers ("pods") running Node.js, Python, PHP, or static websites. Each pod is an isolated Linux container provisioned on our infrastructure.
We may modify, update, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of significant changes.
You must create an account to use the Service. You are responsible for:
You must be at least 16 years old to create an account. You may not create multiple accounts to circumvent plan limits or abuse the Service.
The Service is offered through paid subscription plans ranging from $3/month to $49/month. Each plan includes specific resource allocations (CPU, memory, storage, number of pods). Current plan details are available on our pricing page.
We reserve the right to change pricing with 30 days advance notice. Price changes will not affect your current billing period.
All payments are processed by Stripe. By providing payment information, you also agree to Stripe's Terms of Service.
7-day money-back guarantee: If you are not satisfied with the Service, you may request a full refund within 7 days of your first payment. Contact support@instapods.com to request a refund.
After 7 days: No refunds will be issued for partially used billing periods.
Cancellation: You may cancel your subscription at any time. Your Service will remain active until the end of your current billing period. No further charges will be made after cancellation.
You agree not to use the Service for any of the following:
We reserve the right to suspend or throttle pods that are consuming shared resources in a way that negatively impacts other users. We will attempt to notify you before taking action, except in cases requiring immediate intervention.
You retain full ownership of all code, files, data, and content that you upload to or create within your pods ("Your Content"). InstaPods does not claim any intellectual property rights over Your Content.
You grant us a limited license to host, store, and transmit Your Content solely for the purpose of providing the Service to you.
Data deletion: When you delete a pod, all data within that pod is permanently deleted. We do not retain backup copies of pod data after deletion. You are responsible for maintaining your own backups.
By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Where possible, we will provide notice and an opportunity to resolve the issue before termination.
By you: You may delete your account at any time. Upon account deletion, your pods and associated data will be permanently removed.
In the event of termination for Terms violations, no refund will be issued for the remaining billing period.
We use commercially reasonable efforts to maintain the availability and reliability of the Service. However, we do not guarantee any specific uptime percentage.
The Service may experience downtime due to maintenance, updates, infrastructure issues, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.
The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
To the maximum extent permitted by applicable law, InstaPods' total liability to you for any claims arising out of or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
In no event shall InstaPods be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
We may update these Terms from time to time. When we make material changes, we will notify you via email at least 30 days before the changes take effect and update the effective date at the top of this page.
Continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree with the updated Terms, you may cancel your account before the changes take effect.
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
